What is an T Visa?
The T nonimmigrant status is available to admissible
aliens who are “victims of severe forms of trafficking in persons who
have complied with any reasonable request for assistance in the
investigation or prosecution of acts of trafficking in persons and who
can demonstrate that they would suffer extreme hardship involving
unusual and severe harm if they were removed from the United States.”
(8 C.F.R.§103) If a law enforcement endorsement is not available (which
is primary evidence of the assistance), the Service will accept
secondary evidence. Those that are under 15 years old do not have to
show that they complied with any reasonable request to assist law
enforcement agencies.
